Can anyone clarify if VA disability payments are factored into child support in Colorado? I've heard conflicting info. The court facilitator indicated it should be included as income, but it sounds like the jury's still out on this one.

I can't imagine that if the child is still on the veteran's award they wouldn't at least immediately settle with paying out $139.37 (the difference between vet alone and vet with child) to get the kid's needs taken care of...

Best of luck sorting this situation.

In Colorado and several other states, the process of determining child support involves considering a parent's entire income, which can encompass disability benefits. Federal legislation generally safeguards these benefits from direct garnishment or allocation during divorce proceedings, except in certain cases. Nonetheless, to calculate child support, many states, Colorado included, may treat VA disability benefits as income for child support calculation.
